90-DAY LIMITED WARRANTY

Who is covered by this warranty? Tenka Inc., located at 291 School Street, Suite 3, Willits, CA 95490 (“Tenka Inc.”) extends this limited warranty to the original purchaser of the product during the Warranty Period.
 
What does this warranty cover? This limited warranty covers manufacturing defects in materials and workmanship of your Tenka Inc. -branded product (the “product”) for the Warranty Period defined below. 
 
What does this warranty not cover? This limited warranty does not cover any damage caused by: (1) transportation or storage of the product; (2) improper use of the product; (3) failure to follow the product instructions; (4) modifications to the product, (5) unauthorized repair of the product; (6) normal wear and tear; or (7) external causes such as accidents, abuse, unusual physical or electrical stress, or other actions or events beyond Tenka’s reasonable control. This limited warranty also does not cover disposable items, or parts or components of the product that are inherently subject to deterioration during the normal operation of the product, such as batteries, glue dots, stickers, and project templates. 
 
This limited warranty only covers products purchased from Tenka Inc. or sellers authorized by Tenka Inc., and this limited warranty does not extend to products purchased from unauthorized sellers. You may obtain a current list of authorized Tenka Inc.’s sellers by emailing Tenka’s Customer Service Department. 
 
Many ecommerce websites allow unauthorized resellers to merchandise and offer product on their sites.  Please note only products sold by and shipped from authorized marketplace resellers are covered by this limited warranty.  Proof of purchase from an authorized seller is required for warranty coverage.
 
What is the period of coverage? This limited warranty starts on the date the product is delivered to the original purchaser and lasts for 90 days (that 90-day period, the “Warranty Period”). The Warranty Period is not extended if Tenka Inc. repairs the product, but if Tenka Inc. replaces the product a new Warranty Period will apply to that replaced product starting on the date the replaced product is delivered to you. Tenka Inc. may change the availability of this limited warranty at Tenka’s discretion, but any changes will not be retroactive.
 
What are your remedies under this warranty? With respect to any defective product for which Tenka Inc. has been notified of the defect during the Warranty Period, Tenka Labs will, at Tenka’s discretion, either (1) repair or replace that product (or the defective part) free of charge or (2) refund the purchase price of that product. Tenka Inc. will also pay for shipping and handling fees to return the repaired or replacement product to you if Tenka Inc. elects to repair or replace the defective product. The remedies describe above are Tenka Inc.’s entire liability and your sole remedy for breaches of this limited warranty. Tenka Inc. limits to the duration of this limited warranty the duration of (and available remedies for) all implied warranties, including the warranties of merchantability and fitness for a particular purpose. Some states or jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. Our entire liability for all claims in the aggregate arising out of your purchase or use of the product will not exceed the amount of any actual direct damages up to the greater of $500 or the charges (if recurring, up to a maximum of 12 months’ charges) actually paid by you for the product, regardless of the basis of the claim and regardless of whether any remedy provided by Tenka Inc. fails of its essential purpose. Except as otherwise required by law without the possibility of contractual waiver, Tenka Inc. will not be liable for special, incidental, or consequential damages (including lost profits or savings), even if Tenka Inc. is informed of their possibility. Some states or jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
 
How to you obtain warranty service? To obtain warranty service, you must email the Customer Service Department  before the end of the Warranty Period to obtain a Return Merchandise Authorization (“RMA”) number and a prepaid return shipping label. No warranty service will be provided without an RMA number. You are responsible for printing out and affixing the prepaid shipping label to the outside of your return shipment, and your return shipment must be postmarked no later than ten days after the last day of the Warranty Period.
 
How does state law relate to this limited warranty? This limited warranty gives you specific legal rights, and you may also have other rights, which vary from state to state or jurisdiction to jurisdiction. Nothing in this limited warranty affects any statutory rights of consumers that cannot be waived or limited by contract.
